Terms and Conditions
These Terms govern your use of MarkMyPoint, a website feedback and review service. By creating an account or using the service, you agree to them.
1. Who we are
MarkMyPoint (“we”, “us”, or “the Service”) provides tools to pin feedback on live websites, PDFs, images, and video, and to collaborate with teammates and clients. Questions: hello@markmypoint.com.
2. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account and for any organization you administer. We may suspend or terminate accounts that violate these Terms or that pose a security or abuse risk.
Organization admins control seats, invites, billing (where applicable), and member access. If you leave an organization, that organization may retain content you contributed while a member.
3. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent purposes
- Upload malware, scrape without authorization, or attempt to break or overload our systems
- Harass others, or post content you do not have rights to share
- Circumvent plan limits, access controls, or security features
- Resell or misrepresent the Service as your own product without permission
We may remove content or restrict access when we reasonably believe these rules have been broken.
4. Your content
You (or your organization) retain ownership of projects, MarkUps, pins, comments, uploaded files, and other materials you submit (“Customer Content”). You grant us a limited license to host, process, display, and transmit Customer Content solely to operate and improve the Service for you.
You represent that you have the rights needed to submit Customer Content and to invite others to view or edit it. Feedback data and pins belong to the account or organization that owns the project, subject to any sharing settings you configure.
5. Our service and IP
MarkMyPoint, including its software, branding, and documentation, remains our property. We grant you a non-exclusive, non-transferable right to use the Service according to your plan. These Terms do not transfer any of our intellectual property to you.
6. Plans, billing, and third parties
Free and paid plans are described on our pricing pages. Paid features may be billed through Stripe or another payment processor. Their terms apply to payment processing. Taxes may apply where required.
We also rely on infrastructure and vendors such as hosting providers. Their processing of data is described in our Privacy Policy.
7. Availability
We aim for reliable uptime but do not guarantee uninterrupted service. Maintenance, outages, or third-party failures may occur. We may publish service status updates by email or on our website when a public status page is available.
8. Disclaimer
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that Customer Content will never be lost; you should keep your own backups of important materials.
9. Limitation of liability
To the fullest extent permitted by law, MarkMyPoint and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the twelve months before the claim, or (b) fifty U.S. dollars (US $50) if you use only a free plan.
10. Termination
You may stop using the Service at any time. We may suspend or end access if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive.
11. Changes
We may update these Terms from time to time. We will post the revised version on this page with an updated date. Continued use after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Courts located in the State of Florida may hear disputes arising from these Terms, except where mandatory consumer protections require otherwise.
